Rule 93
Making a judgment or order on behalf of a deceased judge

(1) If the judge who passed the decision dies before being able to write the decision after the judgment has been pronounced according to Rule 89, a judge appointed by the Chief Justice shall take down the decision written by the deceased judge in the note book as a decision and sign the decision.
(2) If the situation under sub-rule (1) occurs in a case considered by a bench of two or more judges, if the judgment of the judges sitting on that bench is unanimous, one of the judges shall sign his signature and state the reason why the other judge is unable to sign. But any judge appointed by the Chief Justice in the decision where there is a difference of opinion shall take down the decision written by the judge who died in the note book as his opinion and sign such decision.
